These Terms & Conditions govern your access to and use of the Navigate Network website, operated by Add Data Pty Ltd (ABN 82 652 866 263). Our paid services are governed by a separate agreement; these Terms apply to the website only.

01 · Section

Acceptance of these Terms.

By accessing or using the Navigate Network website at navigate.network (the “Site”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.

02 · Section

Who we are.

The Site is operated by Add Data Pty Ltd (ABN 82 652 866 263), which operates the Navigate Network cloud platform (“we”, “us” or “Navigate Network”).

03 · Section

Our services.

Information on the Site about our compute, GPU, storage and hosting services is provided for general information only and does not constitute an offer. Provision of any paid services is subject to a separate written agreement (our Master Services Agreement, Service Level Agreement and Acceptable Use Policy). Nothing on the Site is a binding offer, quote or guarantee.

04 · Section

Use of the Site.

We grant you a limited, revocable, non-exclusive licence to access and use the Site for lawful purposes. You must not:

  • Use the Site in breach of any law or to infringe anyone’s rights;
  • Scrape, crawl, harvest or index the Site without our prior written consent;
  • Interfere with, disrupt or place undue load on the Site or its infrastructure;
  • Attempt to gain unauthorised access to any part of the Site or related systems;
  • Introduce malware or any harmful code, or circumvent security measures.

Intellectual property.

The Site and its content — including text, graphics, logos, and trademarks — are owned by or licensed to us and are protected by intellectual-property laws. Except for the limited licence to view the Site, no rights are granted to you, and you may not reproduce, distribute or create derivative works without our prior written consent.

Third-party links and content.

The Site may contain links to third-party websites or resources provided for convenience. We do not endorse and are not responsible for the content, products or practices of any third-party site.

Disclaimers

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties about the accuracy, completeness, reliability or availability of the Site or its content, and we may modify, suspend or discontinue the Site at any time.

Limitation of liability.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or loss of profits or data, arising from your use of (or inability to use) the Site.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to the maximum extent permitted by law.

You agree to indemnify us against any loss, damage or cost arising from your misuse of the Site or breach of these Terms, to the extent permitted by law.

We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.

Changes to the Site and Terms.

We may update these Terms from time to time. The current version will be posted here with its effective date, and your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.

Suspension and termination.

We may suspend or withdraw your access to the Site at any time, including where we reasonably believe you have breached these Terms.

13 · Section

Governing law.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.

14 · Section

General

These Terms are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a corporate reorganisation or sale.
